Fikri Haklarda Kümülasyona Dair Değerlendirme

Abstract

Fikri Mülkiyet Hukuku temel olarak marka, telif hakkı, tasarım, patent ve coğrafi işaret sütunları üzerine inşa edilmiştir. Ancak zamanla gelişen teknik ilerleme ve çeşitlilik karşısında hukuki çözüm bekleyen birçok gri alan ve arayüz alanı ortaya çıkmıştır. Başlangıçta daha basit ve daha spesifik bir alanla sınırlı ve pek çok meseleye dair öngörü ihtiva etmeyen normların, başlangıçta dikkate alınmayan alanlara uygulanabilmesi giderek daha önemli hale gelmektedir. Gerçekten de fikri hakların başlangıçta belirlenmiş sınırlarını aşma eğiliminde olması, gelişen hayat olayları ve teknik gelişmeler ile tartışmalı alanlara dair bu kapsamda belirgin rejimlerin ortaya çıkmamış olması ve geleneksel kuralların hukuk uygulamasına konu olması meseleye dair temel zorluğu teşkil etmekle birlikte yaratımların çok yönlü olması da kümüalsyon ihtimallerini önemli ölçüde artırmaktadır. Gayri maddi unsurları konu edinmesi bakımından geleneksel mülkiyet rejimine yabancı esaslarda gelişmiş alanın içindeki kuralların yorumu ve boşlukların doldurulması pek çok zaman fikri mülkiyet politika ve teorileriyle de alaka kurmayı kaçınılmaz kılmaktadır. Böyle bir soruna bütüncül bir yaklaşımla yaklaşabilmek için, fikri mülkiyet haklarının yetersizliğinin, aşırı koruma olgusunun, fikri mülkiyet haklarına içkin menfaatlerin, rekabet olgusu ve hukuk uygulamasıyla ortaya konması gerekmektedir. Bir taraftan mevcut sütunlara sınırlar çizmek ve sütunların birbirleriyle ilişkilerinin aydınlatılması bakımından fikri hakların kümülasyonu meselesinin değerlendirilmesi gerekecektir.

Evaluation of Intellectual Property Cumulation

Abstract

Intellectual Property Law is basically built on the columns of brand, copyright, design, patent and geographical indication. However, in the face of technical progress and diversity that developed over time, many gray areas and interface areas awaiting legal solutions have emerged. It is becoming more and more important that norms that are initially simpler and limited to a more specific field and that do not contain insights into many issues can be applied to areas that were not initially taken into account. In fact, the fact that intellectual rights tend to exceed the limits determined at the beginning, the fact that there are no clear regimes in this context regarding the developing life events and technical developments and controversial areas, and that traditional rules are subject to law are the main difficulties in the issue, and the multifaceted nature of the creations also poses an important possibility of cumulation. increases substantially. In terms of dealing with intangible elements, the interpretation of the rules and filling the gaps in the field developed on principles foreign to the traditional property regime often make it inevitable to relate to intellectual property policies and theories. In order to approach such a problem with a holistic approach, the inadequacy of intellectual property rights, the phenomenon of excessive protection, the inherent benefits of intellectual property rights must be revealed through the phenomenon of competition and law enforcement. On the one hand, the issue of cumulation of intellectual property rights will need to be evaluated in terms of demarcating the existing columns and clarifying the relations of the columns with each other.
