The Assessments of Case Law of Court of Cassation in respect to Special Appearance Forms of Crime

Abstract

This study aims to indicate how significant are special appear-ance forms of crime such as attempt and participation to crime, and concurrence. However, its scope is limited by the case law of Court of Cassation seeing that the issue of special appearance forms of crime has a broad concept.

Suçun Özel Görünüş Şekillerine İlişkin Yargıtay İçtihatlarının Değerlendirilmesi

Abstract

Bu çalışma ile yeni TCK’nın teşebbüs, iştirak ve içtimaya ilişkin hükümlerinin uygulamaya ne ölçüde taşındığını incelemek amaç-lanmaktadır. Ancak suçun özel görünüş biçimleri konusunu genişli-ği dikkate alındığında bu çalışma, Yargıtay kararları dahilinde ko-nuyu ele almayı amaçlamıştır.
