The Relationship Between the Right to A Fair Trial Within A Reasonable Time and Ascertainment of Content of Foreign Applicable Law in Private International Law Cases
Abstract
The Turkish courts are under the obligation to ascertain the content of foreign law ex officio, which is determined as the applicable law in a case with foreign element, as a requirement of Art. 2 of Turkish Code on Private International Law and International Cıvil Procedure numbered 5718 (CPIL). However, ascertainment of content of foreign law, which has a critical importance in such cases, is a difficult process that takes a certain amount of time. On the other hand, since Art.6/1 of the European Convention on Human Rights as well as Art.36 and 141 of Turkish Constitution impose an obligation to hear such cases within a reasonable time, it is also necessary for the courts to avoid unnecessary delays that may prolong the length of proceedings. The fact that foreign law could not be ascertained in a reasonable time can lead to failure of the trial to be heard within a reasonable period of time, which may lead to violation of the right to trial within a reasonable time. Therefore, the question of how the Turkish courts should strike a balance between these obligations in such cases in order to prevent possible violations of right to fair trial within a reasonable time deserves to be examined in the light of case law of European Court of Human Rights (ECtHR) on right to fair trial within a reasonable time and of a decision which discuss the issue directly.
