Confidentiality Obligation in International Commercial Arbitration
Abstract
Confidentiality and privacy are similar concepts, on the other hand they are also distinctive. International commercial arbitration is commonly chosen by the international commercial practitioners for dispute resolution. Protection of trade secrets and confidential information is a ground for preferring arbitration. Information obtained during arbitral proceedings regarding counterparty, commonly deemed as confidential. Disclosure of such information is considered under the confidentiality obligations in arbitral proceedings.
