ULUSLARARASI ADALET DİVANI’NIN SILALA NEHRİNİN STATÜSÜ VE KULLANIMI UYUŞMAZLIĞI KARARI

Abstract

Uluslararası Adalet Divanı’nın Silala Nehri kararı uluslararası su hukukuna dair önemli ilkelerin ve uygulamaların değerlendirilmesini gerektiren bir karardır. Zira sınıraşan suların kullanımına dair devletler arasında sürekli uyuşmazlık çıkmaktadır. Uyuşmazlıkların çözümünde başvurulan kaynaklar, yöntemler ve uygulamalar devletler arası ilişkileri netleştirmektedir. Ancak Uluslararası Adalet Divanı su hukukuna ilişkin olan bu kararda da yine kısıtlı bir karar vermiş ve beklentileri karşılıksız bırakmıştır. Bu sebeple de eleştirilere maruz kalan bir karar olmuştur. Dolayısıyla Mahkemenin özellikle su hukukuna ilişkin kararlarında bazı durumları netleştirmekten kaçınması dikkat çekmektedir. Bu bağlamda ilgili karar değerlendirilmiştir.
