Abstract
Bu çalışma, endüstriyel mülkiyet haklarının sosyo-kültürel temelleri üzerine odaklaşmaktadır. Tarihsel süreç içerisinde endüstriyel mülkiyetin bir mülkiyet türü olarak ortaya çıkma tarzı ile endüstriyel mülkiyetin oluşumunu etkileyen sosyo-kültürel ve ekonomik koşullar incelenmektedir. Ayrıca, endüstriyel mülkiyet hakları ile kapitalist sanayileşme arasındaki ilişkiler irdelenmektedir. Son olarak, patentlerin ve markaların Venedik, İngiltere ve ABD'deki tarihsel gelişimi hakkında bilgi verilmektedir.

Abstract
This article focuses on the socio-cultural bases of industrial property rights. The way industrial property emerged as a kind of property in historical process and socio-cultural
and economical conditlons influencing the formation of industrial property are examined. Furthermore, relations between industrial property and capitalist industrialization are explored. Lastly, the study provided the historical development of patents and trademarks in Venice, Great Britain and the USA.
