DISCUSSIONS IN TURKEY ON FREEDOM OF PRESS AND NATIONAL SECURITY ALONG WITH A PROPOSED MODEL

Freedom of the press plays an important role in the exercise of the right to information of the society and in the supervision of the government and the bureaucracy. The information obtained by the public through the press mobilizes public control, which is extremely important in the control of the government and the bureaucracy. However, as with all rights and freedoms, freedom of the press has various limits. One of the limits of press freedom is state security. In matters of State Security, the press must maintain legal boundaries. But the issue of State Security is not always very clear. Therefore, the issue of State Security is an important problem that causes controversy between the state and the press and sometimes causes various law suits to be filed. In this problematic area, there is a need to develop a new approach between press freedom and state security. The study will seek to find a healthy balance point between press freedom and state security by including public interest in the analysis. In order to find this equilibrium point, it is aimed to develop a new formulation and a new approach.

Basın özgürlüğü toplumun bilgilenme hakkının kullanılması, hükümetin ve bürokrasinin denetlenmesi açılarından önemli işlevler görmektedir. Basın aracılığıyla toplumun elde ettiği bilgiler hükümetin ve bürokrasinin denetiminde son derece önemli olan kamuoyu denetimini harekete geçirmektedir. Ancak bütün hak ve özgürlüklerde olduğu gibi basın özgürlüğünün de çeşitli sınırları bulunmaktadır. Basın özgürlüğünün sınırlarından biri de devlet güvenliğidir. Devlet güvenliğini ilgilendiren konularda basının hukuki sınırları koruması gerekir. Ancak devlet güvenliği konusu her zaman çok açık değildir. Dolayısıyla devlet güvenliği konusu devlet ile basın arasında tartışmalara neden olan, kimi zaman çeşitli davalar açılmasına neden olan önemli bir problemdir. Bu problemli alanda, basın özgürlüğü ile devlet güvenliği arasında yeni bir yaklaşım geliştirmek ihtiyacı hissedilmektedir. Çalışmada toplum yararını da analize dahil ederek, basın özgürlüğü ve devlet güvenliği arasında sağlıklı bir denge noktası bulma arayışına girilecektir. Bu denge noktasını bulabilmek adına, yeni bir formülasyon, yni bir yaklaşım geliştirilmesi hedeflenmektedir.
