Olağanüstü Halin Teolojik-Politik Soy Kütüğü ve Bir OHAL Cumhuriyeti Olarak İsrail

Abstract

Siyaset felsefesinin sözleşmeci geleneği ve modern Weberyen literatür olağanüstü hali gündelik hayatın rutin akışını bozan istisna hallerinde toplumsal yaşam ve kamu düzeninin korunması ve yeniden tesis edilebilmesi amacıyla başvurulan bir hukuksal aparat olarak kavramaktadır. Ne var ki olağanüstü hal, pozitif hukuk düzleminde ona ilişkin tedvin edilmiş bir yasa bulunsun ya da bulunmasın, hukuku yalnızca istisna hallerinde askıya alan bir aparat olmanın ötesinde, modern devletin vazgeçilmez kurucu teolojik-politik ögelerinden birisidir. Bu çalışma olağanüstü halin modern devletin ortaya çıkması ve meşruiyetini yeniden üretebilmesindeki fonksiyonunu irdeledikten sonra konuyu İsrail devleti özelinde ele almıştır. İsrail gerek kurucu ideolojisinin kırılganlığı nedeniyle, gerek kuruluşu sırasında başvurduğu yöntemler, gayri hukuki eylemler ve bu eylemlere dayanarak yarattığı kazanımları ile bekasını koruyabilme gayesiyle en başından beri OHAL mantığına ve önlemlerine ihtiyaç duymuştur. 1948’den bugüne yürürlükten kaldırılamayan OHAL yasası, İsrail’in başvurduğu her hukuksuz eylemiyle yeniden ürettiği bu ihtiyacın bir neticesidir.
