THE APPROACHES OF THE SCHOOLS OF ECONOMYCS TO THE ENTRY BARRIERS AND ITS LEGAL RESULTS

Abstract

In this study, the concept of entry to the market, which has a significant role in Competition Law applications, was studied. The first competition law in modern sense was accepted in 1890 in USA. In the following years, it was observed that in many democratic countries competition laws were also accepted. However, in the USA, the verdicts regarding the competition law of Federal Trade Commission which is responsible for the enforcement of competition laws have been sources of reference for other countries as well. Federal Trade Commission has ruled differently in similar cases concerning the views of different industrial economists in different periods. One of these controversial issues is entry barriers to the market. Two distinct views have formed in USA regarding this issue. These are Harvard School, which follows traditional approaches and Chicago School, which is famous for liberal views. This study aims at putting forth the views of these two schools regarding the running of markets in general and entry barriers to the market in particular.

Abstract

Bu çaly?mada, Rekabet hukuku uygulamalarynda önemli bir yer tutan piyasaya giri? engelleri kavramy incelenmi?tir. Modern anlamda ilk rekabet yasasy 1890 yylynda ABD'de kabul edilmi?tir. Daha sonraki yyllarda demokratik pek çok ülkede rekabet yasalarynyn kabul edildi?i görülmü?tür. Ancak ABD'de rekabet yasalarynyn uygulanmasyndan sorumlu olan Federal Ticaret Mahkemesi'nin (Federal Trade Commission) Rekabet hukukuyla ilgili kararlary di?er ülkeler içinde bir referans kayna?y olmu?tur. Federal Ticaret Mahkemesi ise, rekabet ihlalleriyle ilgili davalarda, farkly dönemlerde farkly endüstriyel iktisatçylaryn görü?lerini referans olarak aldyklary için benzer davalarda farkly sonuçlara hükmetmi?lerdir. Bu tarty?maly konulardan biri de piyasaya giri? engelleriyle ilgilidir. Bu konuda, Amerika'da iki farkly gelenek olu?mu?tur. Bunlar, geleneksel yakla?ym taraftary olarak Harvard Okulu ile liberal görü?leriyle bilinen Chicago Okuludur. Bu çaly?ma, bu iki okulun genelde piyasalaryn i?leyi?ini özelde ise piyasaya giri? engellerine ili?kin görü?lerini ortaya koymayy amaçlamaktadyr
