An Evaluation of 2 July 2019 Hague Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters

Abstract

The aim of this study is to evaluate the Hague Convention on the Recognition and Enforcement of Foreign Court Decisions, prepared by the Hague Conference on Private International Law (HCCH) of 2 July 2019. This Agreement is a multilateral international agreement that provides uniform conditions for recognition and enforcement. This study will examine the scope of the Convention and conditions for recognition and enforcement of foreign judgments. It will also give some recommendations in case Turkey shall become a Contracting State. This Convention will be a “game changer” in the international dispute mechanism, if ratification is adequately widespread, and it seems that the European Union and China will be the first runners for this.

2 Temmuz 2019 Tarihli Yabancı Mahkeme Kararlarının Tanınması ve Tenfizine Ilişkin Lahey Anlaşmasının Değerlendirilmesi

Abstract

Bu çalışmanın amacı, 2 Temmuz 2019 tarihli Uluslararası Özel Hukuk Konferansı (HCCH) tarafindan hazırlanan Yabancı Mahkeme Kararlarının Tanınması ve Tenfizine İlişkin Lahey anlaşmasının değerlendirilmesidir. Bu Anlaşma, tanıma ve tenfiz konusunda yeknesak koşullar öngören çok taraflı bir uluslararası anlaşmadır. Bu çalışmada, Anlaşma’nın kapsamı ve yabancı mahkeme kararlarının tanınması ve tenfizine ilişkin koşullar incelenecektir. Ayrıca çalışmada, Türkiye’nin ileride bir âkit devlet olması durumuna istinaden, bazı öneriler de yer almaktadır. Bu Anlaşma, onaylama süreci yeterince yaygın olursa, uluslararası uyuşmazlık çözüm mekanizmasında bir “oyun değiştirici” olacaktır. Avrupa Birliği ve Çin bu durumun ilk öncüleri olacak gibi görünmektedir.
