PERİNÇEK v. SWITZERLAND JUDGEMENT OF THE EUROPEAN COURT OF HUMAN RIGHTS
Abstract
The verdict of the ECtHR in Perinçek v. Switzerland affair is awell-reasoned and balanced judgment; it reduces the concept of genocideto law. The ECtHR acknowledges that the Court is not competent toarbitrate upon controversial historical aspects of the past events as wellas on the legal qualification attributed to them. The line of reasoning ofthe Swiss Courts on the matter was troubling as it came very close toestablishing a system which places one single opinion above all others,criminalizes disagreement and precludes any form of debate .The verdictof the ECtHR underlined that expressing opinions on sensitive and debatedissues is a fundamental aspect of freedom of expression and the differencebetween tolerant, pluralist, and democratic society and totalitarianregimes lies in this. The Court concluded that there was no justifiablereason to curtail Dr. Perinçek’s freedom of expression
