Abstract

Peremptory norms of general international law (jus cogens) are norms that aim to protect the fundamental values of the international community, are universal and considered to be hierarchically at the top of other rules of international law. The content of these norms, from which no deviation is allowed, has been a matter of debate for many years. Although the peremptory norms of general international law (jus cogens) are regulated in Articles 53 and 64 of the 1969 Vienna Convention on the Law of Treaties, these two articles are not sufficiently descriptive about the content of this norm. In addition, since this Convention only deals with jus cogens norms in the context of international treaties, there are different international law issues that need to be clarified. For this reason, the International Law Commission started working to clarify the content of jus cogens norms in 2015, and the Commission completed its work in 2022. This study includes the Turkish translation of the International Law Commission's draft conclusions on Peremptory Norms of General International Law (jus cogens).

Uluslararası Hukuk Komisyonu’nun Genel Uluslararası Hukukun Emredici Normları (Jus Cogens) Hakkındaki Taslak Sonuçlar Çalışması ve Çalışmanın Türkçe Çevirisi

Abstract

Genel uluslararası hukukun emredici normları (jus cogens), uluslararası toplumun temel değerlerini korumayı amaçlayan, evrensel nitelikte ve hiyerarşik açıdan uluslararası hukukun diğer kurallarının en tepesinde olduğu düşünülen normlardır. Kendilerinden sapılmasına izin verilmeyen bu normların içeriği uzun yıllar tartışma konusu olmuştur. Genel uluslararası hukukun emredici normları (jus cogens) 1969 Viyana Antlaşmalar Hukuku Sözleşmesinin 53. ve 64. maddelerinde düzenlenmiş olsalar da, söz konusu iki madde bu normun içeriği konusunda yeteri kadar açıklayıcı değildir. Ayrıca bu Sözleşme sadece uluslararası antlaşmalar bağlamında jus cogens normları ele aldığı için aydınlatılması gereken farklı uluslararası hukuk meseleleri söz konusudur. Bu nedenle Uluslararası Hukuk Komisyonu jus cogens normların içeriğini aydınlığa kavuşturmak amacıyla 2015 yılında çalışmaya başlamış ve bu çalışmalar 2022 yılında tamamlamıştır. Bu çalışmada Uluslararası Hukuk Komisyonu’nun Genel Uluslararası Hukukun Emredici Normları (jus cogens) hakkındaki taslak sonuçlar çalışmasının Türkçe çevirisi yer almaktadır.
