Yaşın İlerlemesi ve Olgunlaşma ile Birlikte Suça Katılımın Azalması: Nitel Bir Araştırma

Abstract

Bu araştırmada yaşlanmanın ve olgunlaşmanın suçu terk etme üzerindeki etkisine odaklanılmıştır. Araştırmanın amacını eski hükümlülerin suçu terk etmelerinde etkili olan yaş ve olgunlaşmaya bağlı dinamiklerin saptanması oluşturmaktadır. Çalışmada nitel bir araştırma yöntemi tercih edilmiştir. Çalışmada nitel araştırma modellerinden fenomenolojik araştırma modeli kullanılmıştır. Bu kapsamda cezaevinden çıktıktan sonra en az iki yıldır suç işlememiş ve cezaevi sürecinden sonra en fazla dört yıl geçmiş 50 eski hükümlü ile görüşme gerçekleştirilmiştir. Görüşme gerçekleştirilen eski hükümlüler Diyarbakır’da ikamet eden bireylerden seçilmiştir. Araştırmada katılımcılar suçu terk etmelerini yaşlarının ilerlemesine ve/veya daha da olgunlaşmalarına bağlamışlardır. Bu kapsamda eski hükümlülerin yaşlanmasının ve/veya olgunlaşmasının onların suçu terk etmeleri üzerinde etkili olduğu temel sonucu elde edilmiştir. Ayrıca bu araştırmada cezaevinden çıkan eski hükümlülerin küçük yaşlarda suç işlemelerinin nedeni olarak onların gelecekle ilgili yeterli düzeyde idrak düzeyine sahip olamamaları şeklinde açıklanmaktadır. Bu nedenle yaşın ilerlemesiyle birlikte bireylerin daha akıllı bir şekilde davrandıkları ve riskli eylemlerden kaçındıkları söylenebilir. Bireyin yaşının ilerlemesinin bir sonucu olarak olgunlaşmanın da gerçekleştiği ileri sürülebilmektedir. Bu açıdan zihinsel ve ruhsal olgunlaşma ile birlikte suçu terk etmenin daha kolay olarak gerçekleştiği belirlenmiştir. Yaş değişkeninin etkisinin özellikle hırsızlık suçlarında daha belirgin olarak gözlemlendiği hususuna dikkat çekilmelidir. Çalışma kapsamında küçük yaşlarda işlenmeye başlanan bu suç türünün yaşın ilerlemesiyle birlikte sonradan terk edildiği ileri sürülmüştür.

Declining Participation in Crime with Advancing Age and Maturation: A Qualitative Study

Abstract

This study examines the impact of aging and maturation on criminal desertion. The aim of the research is to determine the age and maturation-related dynamics that are effective in the desertion of ex-convicts. A qualitative research method was preferred in the study. The phenomenological research model, one of the qualitative research models, was used in the study. In this context, interviews were conducted with 50 ex-convicts who had not committed a crime for at least two years after their release from prison and who had not committed a crime for at most four years after their release from prison. The ex-convicts interviewed were selected from individuals residing in Diyarbakır. In the research, the participants attributed their abandonment of crime to their advancing age and/or becoming more mature. In this context, the main conclusion is that the aging and/or maturation of ex-convicts is effective in increasing their desistance from crime. In addition, in this research, the reason why ex-convicts who are released from prison commit crimes at a young age is explained as the fact that they do not have a sufficient level of cognition about the future. Therefore, it can be said that individuals behave more wisely and avoid risky actions with advancing age. It can be argued that maturation also takes place as a result of the advancing age of the individual. In this respect, it has been determined that it is easier to abandon crime with mental and spiritual maturation. It should be noted that the effect of the age variable is more pronounced, especially in theft crimes. Within the scope of the study, it was argued that this type of crime, which started to be committed at a young age, was abandoned later with the advancement of age.
