Abstract
The European Union successfully put forward significant applications and innovations
during its integration process until it reached its current state. One of the important subjects in
the European Integration is freedom of movement of workers. Insıde the Union, from the
notion of free movement of workers such condition as freedom of movements, freedom of
establishment of member states in other member states, freely applying for jobs, freely practicing
their jobs and benefitting equally from the social rights along the citizens of the resident
states is understood. The relations with the Union about free movement of Turkey’s workforce,
whose relations with the EU recently moved to other levels, began with the Ankara Agreements
and the application of the Additional Protocol and were shaped with the decision of Association Council and Court of Justice of The European Communities. In this study which
examines the free movement of workforce, which is the most important acquis between the
European Union and Turkey at this point, on the basis of legal documents, firstly the subject
was approached from the acquis of the EU, and later the parts which were regarded important
in terms of Turkey were mentioned.

AVRUPA BİRLİĞİNDE İŞÇİLERİN SERBEST DOLAŞIMI VE TÜRK İŞÇİLERİNİN DURUMU
Abstract
Avrupa Birliği, bugünkü durumuna ulaşana kadar geçirdiği bütünleşme sürecinde çok önemli uygulama ve yenilikleri başarı ile ortaya koyabilmiştir. Avrupa bütünleşmesi içerisinde en önemli hususlardan bir tanesi de işçilerin serbest dolaşımıdır. Birlik içerisinde işçilerin serbest dolaşımı kavramından; üye ülke vatandaşlarının diğer üye devletlere serbestçe girebilmesi, oturabilmesi, işlere başvurabilmesi, mesleğini icra edebilmesi ve kaldıkları ülkelerin vatandaşlarıyla sosyal haklardan eşit bir biçimde yararlanması gibi durumlar anlaşılmaktadır. Son dönemlerde AB ile olan ilişkileri farklı boyutlara taşınan Türkiye’nin işgücünün serbest dolaşımı konusunda Birlik ile arasında olan münasebetleri Ankara Antlaşmasının yapılması ve Katma Protokolün uygulanması ile başlamış, bunlara dayanılarak alınan Ortaklık Konseyi Kararları ve Avrupa Topluluğu Adalet Divanı kararları ile şekillenmiştir. Gelinen noktada Avrupa Birliği ve Türkiye Arasında en önemli müktesebat konularından birisi olan İşgücünün Serbest Dolaşımını hukuki belgeleri esas alarak inceleyen bu çalışmada önce konuya AB müktesebatı açısından yaklaşılmış, ardından konunun Türkiye-AB ilişkileri açısından önemli görülen kısımlarına değinilmiştir.
