Abstract

The years of 2000’s is described as the beginning of the information age where information technologies have been integrated into virtually every aspect of business and society. The use of internet speeds up to carry out the society from industrilized age to information age, so the use of internet becomes a part of daily life. But the use of internet at the same time , creates a lot of problems itself. The problems which is created by internet transfired in to the law issue. Thus human being is introduced to cybercrime. In this study, the responsibilities of the internet system operators are investigated as regard to the internet criminal law. Because of the lack of regulations, legislations and law on the cybercrime in Turkey,the legislations based on the Europian Council are detemined in this research. Some of the regulations are recommended about the criminal liability of the service providers for the proposal of the Turkish Internet Criminal Law.

Abstract

2000’li yıllar bilgi çağının başlangıcı olarak nitelendirilmektedir. İnternet sanayi toplumundan bilgi toplumuna geçiş sürecini hızlandıran en temel etkenlerden birisidir. İnternet bugün günlük hayatımızın vazgeçilmez bir unsuru olmuştur. Beraberinde bir çok sorunlar da ortaya çıkmıştır. İnternetin toplum hayatında yarattığı sorunlar hukuk alanında da kendini göstermektedir. Bu sayede insanoğlu internet suçları ile tanışmıştır. Bu çalışmada internet sistem operatörlerinin internet ceza hukukundaki sorumlulukları incelenmektedir. Ülkemizde bu konuda henüz yasal bir düzenleme yürürlüğe konulmadığı için Avrupa Konseyi’nin bu husustaki düzenlemeleri ve kuralları dikkate alınarak servis sağlayıcıların cezai sorumluluğu konusunda ülkemizde yapılacak olan yasal düzenlemelere öneriler sunulmuştur.
