Abstract
Mental disordement is an important factor to reduce the criminal responsibility of the
mental disordered people in criminal law. Being mental disordement removes their case
responsibility. As a result of this, any mental disordered people who does crime are not
responsible for criminal law.
The responsibility or the reduce responsibility of the criminal are determined by the
decision of the psychrician. But neither the doctor nor the judge are mostly to be far from
satisfaction
Abstract
Ceza Hukukunda akıl hastalığı ceza sorumluluğunu ortadan kaldıran veya önemli derecede azaltan sebeplerden sayılmaktadır. Akıl hastalığı ceza sorumluluğunun unsurlarından isnad yeteneğini ve dolayısıyla kusuru ortadan kaldırmaktadır. Bu nedenlerden dolayı suç işleyen akıl hastalarının ceza sorumlulukları yoktur. Suçlunun ceza sorumluluğu veya azaltılmış ceza ceza sorumluluğu psikiyatristin vereceği rapora dayalı olarak saptanmaktadır. Çoğu zaman ne uzman doktor ne de hakim tatminkar bir cevap bulmaktan yoksundur.
