"Sözünde Duran Türk”, “Sözünde Durmayan Türk”e Karşı (mı?) Yahut Fıkıh Bilmek Osmanlı Tarihçilerinin Ne İşine Yarar?

Abstract

15. yüzyıldan itibaren Batılı müellifler tarafından şekillendirilen Türk imgesinin ana tartışma konularından biri, Türklerin gayrimüslim topluluklarla akdettikleri antlaşmalara sadakat gösterip göstermedikleri, diğer bir ifadeyle, verdikleri sözleri tutup tutmadıkları meselesidir. Bu hususta eser veren müelliflerin kahir ekseriyeti, Türklerin barış antlaşmalarına hiçbir zaman sadık kalmadıklarını ve buldukları ilk fırsatta bu antlaşmaları ihlal ettiklerini iddia ederken, az sayıda yazar ise Türklerin vefalı olduğunu savunmakta ve bu görüşlerini somut örneklerle desteklemektedir. Birbirine tamamen zıt iki görüşü barındıran bu tartışmayı, Britanya Akademisi üyesi İngiliz tarihçi Noel Malcolm'un (d. 1956) Useful Enemies, Islam and The Ottoman Empire in Western Political Thought, 1450-1750 başlıklı eserindeki bakış açıları merkezinde inceleyen bu çalışma, Osmanlı hukukunun temelini oluşturan ve bir kısmı Osmanlı hukukçuları eliyle de üretilen Hanefi fıkıh literatürünün savaş hukuku ve zimmî ahkâmına yaslanmakta ve Batı muhayyilesindeki Türk tasavvuruna yönelik her iki söylemin de doğruluk payının bulunduğunu, birbirleriyle çelişkili olmadığını ve farklı durumlara atıf yaptığını göstermeyi amaçlamaktadır. Bu doğrultuda, Türklerin sözlerinde durmadıkları iddialarının, fıkıh açısından tarafları bağlayıcı olmayan akit niteliğindeki ateşkes antlaşmalarıyla; verdikleri sözleri tuttuklarına dair iddiaların ise bağlayıcı nitelikteki zimmet antlaşmalarıyla ilgili olabileceği, Hanefi fıkhının temsil gücü yüksek metinlerine referansla ele alınmaktadır.

Why the Dichotomy of Promise-Keeping vs. Promise-Breaking Turk is False and How Can Ottoman Historians Learn from Fiqh?

Abstract

Since the 15th century, one of the central debates surrounding the perception of the Turks, as shaped by Western authors, concerns the extent to which the Turks honored treaties made with non-Muslim communities, or more precisely, whether they upheld their commitments. The majority of authors writing on this topic assert that the Turks routinely violated peace treaties, breaking them at the earliest opportunity. However, a minority of writers argue that the Turks demonstrated loyalty to their agreements, providing concrete examples to substantiate their claims. This study, focusing on this dichotomy of perspectives as examined by British historian and Fellow of the British Academy, Noel Malcolm (b. 1956), in his work Useful Enemies, Islam and The Ottoman Empire in Western Political Thought, 1450-1750, analyzes the positions of both camps. The study draws on Hanafi legal literature-particularly concerning the laws of war and regulations regarding dhimmis-which formed the foundation of Ottoman law and was partially authored by Ottoman jurists. It aims to demonstrate that both discourses on the Turkish image in Western imagination contain elements of truth and are not inherently contradictory, but rather refer to different circumstances. In this context, the study argues, with reference to authoritative texts in Hanafi jurisprudence, that instances where the Turks did not fulfill their promises were likely related to truce agreements, which are considered non-binding in Islamic legal terms, whereas instances where they did adhere to their commitments pertained to dhimma agreements, which are legally binding for both parties.
