Charles Crozat'nın Vichy Fransasına Dair Öngörüleri: Yeni Fransız Kanun-ı Esasîsi Başlıklı Gazete Yazısı

Abstract

Bu çalışma, İstanbul Üniversitesi Hukuk Fakültesinde uzun yıllar görev yapmış Fransız kamu hukukçusu Charles Crozat’nın, II. Dünya Savaşı esnasında Fransa'nın mağlubiyetiyle Vichy'de toplanan parlamentonun faaliyetleri üzerine kaleme aldığı "Yeni Fransız Kanun-ı Esasîsi" başlıklı gazete yazısını incelemektedir. Tasviri Efkâr gazetesinde 1940 Temmuz ayında yayımlanan bu yazı dizisinde Crozat, Fransa'nın geçmiş anayasal deneyimlerini ve III. Cumhuriyet uygulamasını değerlendirmektedir. Çalışmada Crozat'nın kısa biyografisinin yanı sıra, yeni anayasada gerçekleşeceğini öngördüğü yasama erkinin ıslahı, mesleki meclisler, Danıştay'ın rolünün artırılması, korporatif yapılar ve şahsiyetçi kamu özgürlükleri gibi anayasal tahmin ve beklentileri ele alınmaktadır. Charles Crozat's Predictions on Vichy France: The Newspaper Article Titled "The New French Constitution"

Abstract

This study examines the newspaper article titled "The New French Constitution" written by French public lawyer Charles Crozat, who worked for many years at Istanbul University Faculty of Law, regarding the constitutional developments following the defeat of France in World War II and the subsequent assembly of the parliament in Vichy. Published as a series in the daily newspaper Tasviri Efkâr in July 1940, Crozat's text evaluates France's past constitutional experiences, specifically the 1875 Constitution and its practice. Along with a brief biography of Crozat, this paper analyzes his constitutional predictions and expectations, such as the reform of the legislative power, professional assemblies, the expanded role of the Council of State, corporatist structures, and personalist public liberties.
