Mirasın Kazaen Taksimi
Abstract
Bu çalışma, Türkiye'de mirasın kazaen taksimi konusunu, mevcut şer'î-kanunî mevzuatın eksiklikleri ve bu eksikliklerin doğurduğu iktisadi, içtimaî mahzurlar çerçevesinde ele almaktadır. Çalışmada, Tanzimat sonrası Osmanlı hukukunda miras taksimini düzenleyen Mecelle-i Ahkâm-ı Adliye'nin Kitab-ı Şirket hükümleri ile Emval-i Eytamın Suret-i İdaresi Hakkında Nizamname ve Bi'l-iştirak Tasarruf Olunan Emval-i Gayrimenkulenin Taksimi Hakkında Kanun-ı Muvakkat hükümleri ayrıntılı bir biçimde tasvir edilmektedir. Yazar, özellikle terekede yetim (sağir) veya gaib bulunması durumunda cebrî taksim ve müzayede ile satış zorunluluğunun; aile birliğini, babadan kalma ticarî, sınaî ve ziraî işletmeleri parçalayarak iktisadi çöküşe nasıl zemin hazırladığını ortaya koymaktadır. Mukayeseli hukuk kısmında ise başta İsviçre Medeni Kanunu olmak üzere Fransa, Belçika, İtalya, İspanya ve Almanya mevzuatları incelenerek; tarım arazilerinin asgari sınırlardan daha fazla parçalanmasının önlenmesi, işletmelerin ehil vârise bütünlük içinde devredilmesi, hâkime takdir yetkisi tanınması ve veli/vasi denetimiyle yetimlerin haklarının müzayedesiz korunması gibi modern çözüm önerileri tartışılmaktadır. The Judicial Partition of Inheritance
Abstract
This study examines the judicial partition of inheritance in Turkey, focusing on the deficiencies of the existing legal framework and the economic and social drawbacks they entail. The article provides a detailed description of the post-Tanzimat Ottoman legal codes governing the division of estates, specifically the provisions in the Book of Partnership of the Mecelle-i Ahkâm-ı Adliye, the Regulation on the Administration of the Estates of Orphans (Emval-i Eytam Nizamnamesi), and the Provisional Law on the Partition of Jointly Owned Real Estate. The author highlights how the legal requirement for compulsory judicial partition and public auction in cases involving minor (orphan) or absent heirs disrupts family solidarity and leads to the fragmentation and eventual ruin of inherited family businesses, industrial enterprises, and agricultural estates. In the comparative law section, the civil codes of France, Belgium, Italy, Spain, Germany, and particularly Switzerland are analyzed. The study discusses modern legal solutions such as preventing the excessive fragmentation of agricultural lands below certain minimum sizes, transferring integrated family enterprises to the most capable heir, granting broader discretionary powers to judges, and safeguarding the rights of minors through strict guardianship supervision without necessitating forced public sales.
