Hukuk Reformu Metinleri - Giriş ve İlk Metin: Kont Ostrorog'un Kişi Hürriyetleriyle İlgili 1907 Tarihli Raporu

Abstract

Bu çalışma, Osmanlı Devleti'nin son döneminde ve erken Cumhuriyet yıllarında kaleme alınmış "ıslahat-ı adliye" ve hukuk reformu konulu metinleri bir araya getirmeyi amaçlayan bir yazı dizisinin girişini ve ilk metnini oluşturmaktadır. İlk metin olarak, Osmanlı adli reform çalışmalarında önemli bir figür olan Leh asıllı Fransız hukukçu Kont Léon Ostrorog'un (1867-1932) kişi hürriyetleriyle ilgili 1907 tarihli raporunun çeviriyazısı sunulmaktadır. Rumeli ıslahatı bağlamında bir yabancı devlet sefirinin talebi üzerine hazırlanan ve 1909 yılında İlm-i Hukuk ve Mukayese-i Kavânîn Mecmuası’nda yayımlanan bu raporda Ostrorog; kişi hürriyetine yönelik ihlalleri idari, adli ve şahsi açılardan tahlil etmektedir. Fransız ve Osmanlı ceza mevzuatını karşılaştırmalı olarak ele alan yazar, Osmanlı hukukundaki hürriyet-i şahsiye teminatı noksanlıklarını ortaya koyarak bu noksanların telafisi için memurların adli muafiyetlerinin kaldırılması başta olmak üzere yargılama usullerine dair 10 maddelik bir reform önerisi sunmaktadır. Ottoman Legal Reform Texts - Introduction and the First Text: Count Ostrorog's Report Dated 1907 on Personal Liberties

Abstract

This study marks the introduction and presents the first text of a series aimed at compiling documents on judicial and legal reform written during the late Ottoman Empire and the early years of the Republic. As the initial text, it provides the transliteration of the 1907 report on personal liberties by Count Léon Ostrorog (1867-1932), a Polish-born French jurist who played a significant role in Ottoman judicial reform. Prepared upon the request of an ambassador of a Great Power within the context of the Rumelia reforms and published in the Journal of Science of Law and Comparative Legislation in 1909, Ostrorog analyzes violations of personal liberty from administrative, judicial, and individual perspectives. Comparing French and Ottoman criminal legislation, the author highlights the deficiencies in the guarantees of personal liberty in Ottoman law. To remedy these shortcomings, he proposes a 10-article reform package concerning judicial procedures, with the abolition of judicial immunities for civil servants as a prerequisite.
