Abstract

Bu çalışma, Maurits H. Van den Boogert'in 18. yüzyılda Osmanlı hukuk sistemi içerisinde kadılar, konsoloslar ve beratlı tüccarlar arasındaki ilişkileri incelediği eserinin bir değerlendirmesidir. Yazar, kapitülasyonların sanıldığının aksine Osmanlı hukuk sistemi dışında kalmadığını ve "İslam Hukuk Üçgeni" bağlamında Osmanlı yargı makamlarıyla uyum içinde uygulandığını belirtmektedir. Eserde, beratlıların durumu, avania uygulamaları, iflas ve mülk taksimi gibi konular incelenirken, Batılı kaynakların Osmanlı adli sistemine yönelik abartılı ve izolasyonist iddiaları da eleştirilmektedir.
