An Analysis of Existing Problems in the Relationship of Space Law and International Law

Abstract

The launch of the first artificial satellite Sputnik I into space in October 1957 by the Soviet Union intensified the competition in the international arena, this time in a different area, in space. After the Soviet Union sent Sputnik II into space, the USA sent Explorer-I into space in 1958, Yuri Gagarin was recorded as the first person to go into space in 1961, and the first human walk on the Moon took place in 1969. Thus, the space race started, the possible risks and threats that the subject might bring were understood, and the need to regulate space and activities in space emerged. In line with this need, general regulations on space and space activities were studied under the expertise of the United Nations and space law was established. However, the existing deficiencies in the regulations on space law have affected the relationship between international law and space law, and have led to the emergence of different discussion points. In particular, the existence of ambiguous issues in treaties, conventions and general principles, which are the primary sources of space law, are priorities that need to be resolved, considering the possible risks and threats that may arise in the international arena.
In the study, the current problems of space law will be discussed with a comparative analysis on the primary sources of space law, and the relationship between international law and space law will be evaluated through these problems. The aim of the study is to examine the problems brought by space law in terms of international law and to reveal the necessity of solving these problems immediately.

Uzay Hukuku ve Uluslararası Hukuk İlişkisinde Mevcut Sorunlara Dair Bir Analiz

Abstract

Ekim 1957’de ilk yapay uydu olan Sputnik I’in Sovyetler Birliği tarafından uzaya fırlatılması, uluslararası alanda var olan rekabeti bu kez farklı bir alanda, uzayda, daha fazla kızıştırmıştır. Sovyetler Birliği’nin Sputnik II’yi uzaya göndermesinin ardından ABD 1958’de Explorer-I’i uzaya göndermiş, Yuri Gagarin 1961’de uzaya giden ilk insan olarak kayıtlara geçmiş, 1969’da Ay’da ilk insan yürüyüşü gerçekleşmiştir. Böylece uzay yarışı başlamış, konunun getirebileceği muhtemel risk ve tehditler anlaşılmış, uzayı ve uzaydaki faaliyetleri düzenleme ihtiyacı ortaya çıkmıştır. Bu ihtiyaç doğrultusunda Birleşmiş Milletler’in uzmanlığı altında uzay ve uzay faaliyetleri ile ilgili genel düzenlemeler üzerinde çalışılmış ve uzay hukuku oluşturulmuştur. Ancak, uzay hukukuna yönelik düzenlemelerdeki mevcut eksiklikler uluslararası hukuk ile uzay hukuku ilişkisini etkilemiş, farklı tartışma noktalarının ortaya çıkmasına yol açmıştır. Özellikle, uzay hukukunun birincil kaynakları olan antlaşma, sözleşme ve genel ilkelerde muğlakta kalmış konuların varlığı, uluslararası alanda ortaya çıkacak muhtemel risk ve tehditler düşünüldüğünde, çözüme ulaştırılması gereken önceliklerdir.
Çalışmada, uzay hukukunun birincil kaynakları üzerinden karşılaştırmalı bir analiz ile uzay hukukunun mevcut sorunları ele alınacak, uluslararası hukuk ile uzay hukuku ilişkisi bu sorunlar üzerinden değerlendirilecektir. Çalışmanın amacı, uluslararası hukuk açısından uzay hukukunun getirdiği sorunları incelemek ve bu sorunların ivedilikle çözülmesinin gerekliliğini ortaya koymaktır.
