Rustam Atadjanov'un "Humanness as a Protected Legal Interest of Crimes Against Humanity" İsimli Kitabı Üzerine Bir İnceleme

Abstract

Bu makale Atadjanov'un "Humanness as a Protected Legal Interest of Crimes Against Humanity" başlıklı kitabının bir incelemesi niteliğindedir. Hem ulusal hem evrensel düzlemde ortak bir "insanlık" tanımına vurgu yapan yazar, bu konseptin hem kavramsal hem de normatif açıdan uluslararası ceza hukuku literatürü bağlamındaki bir analizine yer verir. Pozitif hukuk bağlamında eksikliğine vurgu yapılan evrensel bir "insanlık" tanımını problem olarak belirten Atadjanov, bu sebeple hem uluslararası hem de ulusal düzlemde uygulanabilir bir insanlık teorisini hedefler. Kitabın geneline bakıldığında ekseriyetle detaylı ve bir o kadar da kapsamlı bir insanlık kavramı sorgulaması ile karşılaşılır. Bu incelemede kitabın bir ön izlemesine, yazarın bahsi geçen hedefini teorik, kavramsal ve soyut açıdan başarıyla gerçekleştirdiğine, ve yazarın uygulanabilirlik açısından soru işaretleri bıraktığı noktalara değiniliyor. Ağırlıklı olarak betimsel analiz niteliğindeki bu kitap incelemesi, ortaya attığı bu soru işaretleri ile kritik açıdan da yazara göz kırparken tek temennisi bu alanda yeni çalışmalara mütevazı bir katkıda bulunmuş olmaktır.

On Rustam Atadjanov's "Humanness as a Protected Legal Interest of Crimes Against Humanity: Conceptual and Normative Aspects"

Abstract

This article reviews Atadjanov's book titled "Humanness as a Protected Legal Interest of Crimes Against Humanity." The author includes an analysis of the concept of humanity in the context of international criminal law literature in both conceptual and normative terms. Stating the need for a universal definition of "humanity" in the context of positive law, Atadjanov aims at a theory of humanity that can be applied internationally and domestically. Throughout the monograph, both detailed and comprehensive questioning of "humanity" is often encountered. In this review, an overview of the book, the author's achievement in the theoretical, conceptual, and abstract examination, and the points leading a question mark in terms of applicability and practice are mentioned. This book review is a predominantly descriptive analysis, and the reviewer's only wish with this critical question mark in practical and cultural terms is to humbly conduce toward new questions that would lead future studies in this field.
