Bütçe Dışı Hükümler

The starting point of this study is the article 161/4 of the 1982 Constitution. The expression of “No provisions other than those pertaining to the budget shall be included in the Budget Act” which is drawn in the article and how shall it be understand will be emphasized. However, it can be observed that in the application this rule is not always followed. Hence it is difficult to pass an act at the parliament in the times of political instability; it is possible to expand the budget act by adding several provisions to it. The reasons and the results of this application will be examined in the article.

Bu çalışmanın hareket noktası 1982 Anayasasının 161/4. maddesidir. Maddede kaleme alınan “Bütçe kanununa, bütçe ile ilgili hükümler dışında hiçbir hüküm konulamaz” ifadesinin nasıl anlaşılması gerektiği üzerinde durulacaktır. Ancak, uygulamada her zaman söz konusu kurala uyulmadığı gözlenmektedir. Siyasal istikrarsızlık dönemlerinde yasama organından yasa çıkartmak zor olduğu için, bütçe yasasına çeşitli hükümler konularak bütçe yasalarını genişletme yoluna gidilmesi mümkündür.
