6502 Sayılı Tüketicinin Korunması Hakkında Kanun’a Göre Taksitle Satış Sözleşmesi

In the legalization process which is our country is in, in terms of consumer transactions and resolving problems more effectively in order to protect consumers, the Law Protection of the Consumer Act, No. 6502 was adopted. The Law Protection of the Consumer Act, No. 4077, to be valid from the date of 28.5.2014 is repealed. In this study, agreement of sales on installment, as regulated in between articles 17-23 of the Law Protection of the Consumer Act, No. 6502, will examined and compared with the Law Protection of the Consumer Act, No. 4077 and Turkish Code of Obligations No. 6098. In this context, information will be given about the definition of agreement of sales on installment, legal qualification, elements, application area in terms of person and transactions in respect of the same economic purpose, the right of withdraw and the consumer’s default.

Ülkemizin içerisinde bulunduğu kanunlaşma sürecinde, tüketici işlemleri bakımından karşılaşılan sorunların çözülmesi ve tüketicinin daha etkin bir şekilde korunabilmesi amacıyla, 6502 sayılı Tüketicinin Korunması Hakkında Kanun kabul edilmiştir. 4077 sayılı Tüketicinin Korunması Hakkında Kanun ise 28.5.2014 tarihinden itibaren geçerli olmak üzere yürürlükten kaldırılmıştır. Çalışmamızda 6502 sayılı TKHK’nin 17 ila 23. maddeleri arasında düzenlenmiş bulunan taksitle satış sözleşmesi, 4077 sayılı TKHK ve 6098 sayılı Türk Borçlar Kanunu ile karşılaştırmalı olarak incelenmiştir. Bu kapsamda taksitle satış sözleşmesinin tanımı, hukuki niteliği, unsurları, kişi ve aynı ekonomik amaçla yapılan işlemler bakımından uygulama alanı, cayma hakkı ve tüketicinin temerrüdüne ilişkin bilgi verilmiştir
