Hekimin Mesleki Sorumluluk Sigortası

Doctors working in public or private health institutions and specialists and dentists according to the Medical Specialty Legislation are obliged to get Professional responsibility insurance in order to meet compensation demands regarding to the damage they caused due to their professional activities and juridical expenses, interest and reasonable costs which occured in the previous ten-year period from the date of their contract, within the contract period or in the following two years after the expiry of their contract period. The professional liability insurance is a contract; includes responsibilities about professional activities and loads debt both sides. By this contract the insurant is under an obligation to compensate premium payment while the risk insurer is under an obligation to compensate the damage if it occurs. In addition, insured physicians working in private or public organizations are made responsible institutions and organizations they work pay for the half of the premium while of self-employed physicians have to pay insurance premiums on their own.

Kamu veya özel sağlık kurum ve kuruluşlarında çalışan veyahut serbest olarak mesleğini icra eden hekimler, tıpta uzmanlık mevzuatına göre uzman olan hekimler ve diş hekimlerinin, sözleşme tarihinden önceki on yıllık dönemde, sözleşme süresi içinde veya sözleşme süresinin bitiminden itibaren iki yıllık sürede mesleki faaliyeti nedeniyle verdikleri zararlara ilişkin tazminat talepleri ile birlikte yargılama giderleri, faiz ve makul giderlerinin karşılanması hususunda mesleki sorumluluk sigortası yaptırması zorunludur. Mesleki sorumluluk sigortası, münhasıran mesleki faaliyetlerden doğan sorumlulukları ihtiva eden ve iki tarafa borç yükleyen bir akit olup; bu akit ile sigortalı prim ödeme, sigortacı ise riziko gerçekleştiğinde zararı tazmin etmek yükümlülüğü altına girmektedir. Ayrıca; özel veya kamu kurum ve kuruluşlarında çalışan sigortalı hekimlerce ödenmesi gereken prim borcunun yarısı, bünyesinde görev yaptıkları kurum ve kuruluşlarına ait iken, serbest çalışan hekimlerin sigorta primlerinin tamamı kendileri tarafından ödenmektedir.
