Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun'a Göre Riskli Yapı Tespitinde Karşılaşılan Uygulama Problemlerinin Vaka Tabanlı İncelenmesi: Tekirdağ İli Örneği

Kentler karmaşık ve dinamik sistemlerdir: zamanla gelişmekte ve dönüşmektedirler. Ekonomideki değişimler veya ekonomik düzenin değişmesiyle kentsel alanlarda bir takım değişimler ve dönüşümler yaşanmaktadır. Kentsel dönüşüm uygulamaları da kentsel alanlarda yapısal bir değişimi de ifade etmektedir. Aynı zamanda, kentlerdeki farklı sosyal, fiziksel, siyasal ve ekonomik değişimlerden dolayı, köhneme ve çöküntü bölgeleri oluşmakta ve bu alanlar dönüşüm çalışmalarıyla yeniden canlandırılmaya çalışılmaktadır. Bu çalışmada 6306 sayılı Afet Riski Altındaki Alanların Dönüştürülmesi Hakkında Kanun ve uygulama yönetmeliğinin Riskli Yapıların Belirlenmesi ile ilgili hükümlerinin uygulanması esnasında karşılaşılan problemler incelenmiştir. Bu kanun ve uygulama yönetmeliğinin yeni hazırlanmış olması sebebiyle uygulama esnasında birçok konuda sorunlarla karşılaşılmaktadır. Çalışmada Riskli Yapı Tespit Raporları hazırlama süreci tarif edilerek, Tekirdağ ilinde uygulama süreçleri boyunca yaşanılan sorunlar tespit edilmiştir. Sürece tesir eden olumsuzlukların çözümü üzerine öneriler geliştirilmiştir.

Cities are complicated and dynamic systems: they are developing and transforming over time. With the changings in the economy or the changing of the economic system there are seen some changings and transforming in urban areas. Applications of urban transformation also expresses a structural changing in urban areas. At the same time, different social, physical, political and economic changings in the cities are the reason for the creation of old fashioned and sinking areas and it is been trying with transforming studies to restore those areas. A research was made about the problems faced during identifying the constructions which are under risk and application of 6306 numbered law and regulation of application regarding converting the areas which are under the risk of disaster. With the new preparations of this law and governing regulations, problems appeared in many things during the application. The problems occurred during the application period in Tekirdağ were identified with the description of the Risky Construction Determination Report in the study. Offerings were developed about regarding the solution of the hitches which effect the process.
