İslâm Hukukunda Evlenmeden Doğan Haklar Bağlamında Nafaka

Islam guaranteed the right of life. Living of men is possible with the provision of facilities like food, clothing and house. Therefore, from the beginnig of matrimony has been established, Islam wanted the husband to look after his wife and his children and made a great deal of sanctions for those who violates any of these responsibilities. In this study, it had been discussed the financial responsibilities which Islam loaded the husband as for the keep of the institution of the family and to protect the woman’s right of life and made sanctions those who eliminates this responsibility considerations.

İslâm dini yaşama hakkını güvence altına almıştır. İnsanın yaşayabilmesi ise yiyecek, giyecek ve mesken gibi imkânların sağlanmasıyla mümkündür. Bu sebeple İslâm evlilik bağı kurulduğu andan itibaren kocayı kadının ve çocuklarının bakımından sorumlu tutmuş ve bu sorumluluğu ihlal edenler için birtakım müeyyideler getirmiştir. Bu çalışmada İslâm hukukunun evlilik birliği kurulduğu andan itibaren aile kurumu devam ederken ve ayrılma (boşanma) halinde iddet müddeti içerisinde kadının yaşama hakkını korumaya yönelik olarak kocaya yüklenen malî sorumluluklar ve bu sorumluluğu orta dan kaldıran hususlar ele alınmıştır.
