Bağımsız Çalışanların Toplu Pazarlık Hakkı

Öz

İş hukukunun kişi bakımından kapsamında, işi veren kişiye bağımlı olarak bir ücret karşılığı iş gören kişi, yani işçiler bulunmaktadır. Aslında iş hukukunun bir iş sözleşmesi kapsamında çalışan bağımlı çalışanların hukuku olduğu söylenebilecektir. Dolayısıyla Türkiye’deki yasal belgelerde bir tanımı bulunmayan bağımsız çalışanlar iş hukukunun kapsamı dışında değerlendirilmektedir. Ancak ortaya çıkan yeni çalışma şekilleri, dünyada meydana gelen teknolojik, sosyolojik ve ekonomik değişimler, işçi ile bağımsız çalışan arasındaki sınırı bulanıklaştırmakta ve bir gri alan yaratmaktadır. Bu bağlamda bağımsız çalışan olarak kabul edilen kimi grupların hukuki durumlarının düzenlenmesi ve bu grupların belirli noktalarda işçilermiş gibi korunması ihtiyacı da günden güne artmaktadır.
Uluslararası hukuk ve yabancı hukuka bakıldığında, bağımsız çalışanlar için yapılan düzenleme alanlarından bir tanesinin de toplu pazarlık hakkı çerçevesinde gerçekleştirildiği görülmektedir. Özellikle ekonomik bağımlılık kavramı etrafında şekillenen ve bağımsız çalışanların bir kategorisi olarak kabul edilen ekonomik yönden bağımlı bağımsız çalışanlar için toplu pazarlık hakkı kimi ülkelerde tanınmaktadır. Bu kapsamda ilgili bu çalışmada, uluslararası ve yabancı hukukta bağımsız çalışanların toplu pazarlık hakkına ilişkin düzenlemeler incelenecek ve bağımsız çalışanlara toplu pazarlık hakkının tanınıp tanınmaması Türk iş hukuku açısından değerlendirilecektir. Uluslararası hukuk ve yabancı hukuka bakıldığında, bağımsız çalışanlar için yapılan düzenleme alanlarından bir tanesinin de toplu pazarlık hakkı çerçevesinde gerçekleştirildiği görülmektedir. Özellikle ekonomik bağımlılık kavramı etrafında şekillenen ve bağımsız çalışanların bir kategorisi olarak kabul edilen ekonomik yönden bağımlı bağımsız çalışanlar için toplu pazarlık hakkı kimi ülkelerde tanınmaktadır. Bu kapsamda ilgili bu çalışmada, uluslararası ve yabancı hukukta bağımsız çalışanların toplu pazarlık hakkına ilişkin düzenlemeler incelenecek ve bağımsız çalışanlara toplu pazarlık hakkının tanınıp tanınmaması Türk iş hukuku açısından ayrıca değerlendirilecektir.

Collective Bargaining Right of Self-Employed Persons

Within the scope of labor law in terms of ratione personae, there are people who perform to work in return for a wage, i.e., employees, who are in a relationship of subordination to employers. In this context, it can be said that labor law is the law of dependent workers working under an employment contract. Therefore, self-employed persons who do not have a definition in legal documents in Türkiye are considered outside the scope. However, new forms of work, and technological, sociological, and economic changes in the world blur the boundaries between employee and self-employed day by day and create a grey area.
Therefore, the need to regulate the legal status of some groups considered as self-employed and to protect these groups as employees at certain points is growing.
When international law and foreign law are scrutinized, it is seen that one of the areas of regulation for the self-employed is realized within the framework of the collective bargaining right. The collective bargaining right for economically dependent independent workers, which is formed around the term of economic dependency and accepted as a subcategory of self- employed, is regulated in some countries. In this context, this study will examine the collective bargaining rights of self-employed in international and foreign law, and the recognition of that right for them will be evaluated in terms of Turkish labor law. When international law and foreign law are scrutinized, it is seen that one of the areas of regulation for the self-employed is realized within the framework of the collective bargaining right. The collective bargaining right for economically dependent independent workers, formed around economic dependency and accepted as a subcategory of self-employed, is regulated in some countries. In this context, this study will examine the collective bargaining rights of self-employed in international and foreign law, and the recognition of that right for them will also be evaluated in terms of Turkish labor law.
