The Question of Derogations in European Integration Studies

Abstract

This essay aims to investigate the role of derogations in European integration studies. Accordingly, the following questions will be discussed: how is a derogation defined within the EU context? Who attributes the derogatory rights to whom and under what conditions? What are the implications of derogations on the ongoing integration process? The question of derogations has been partially covered by studies in law, organizational sociology and political science. This study puts forward conceptual and theoretical criticisms against the issue of derogations and demonstrates the limitations of the rationalist accounts of European integration through an investigation of various cases of EU derogations.

AVRUPA BÜTÜNLEŞMESİ ÇALIŞMALARINDA DEROGASYONLAR MESELESİ

Abstract

Bu çalışmanın amacı, Avrupa bütünleşmesi çalışmalarında derogasyonların rolünü incelemektir. Bu kapsamda şu sorulara yanıt aranmaktadır: Derogasyon Avrupa bütünleşmesi bağlamında nasıl tanımlanmaktadır? Derogasyon hakkı kim tarafından hangi kriterlere göre devletlere verilebilir? Bütünleşme sürecine derogasyonların etkisi nasıl olmuştur? Yer yer Hukuk, örgüt sosyolojisi ve siyaset bilimi literatürlerinde konu edilen derogasyon meselesine kavramsal ve kuramsal açıdan eleştiriler getiren bu çalışma, çeşitli AB derogasyonlarının vaka analizleri yoluyla Avrupa bütünleşmesine ilişkin rasyonalist açıklamaların yetersiz kaldığını göstermektedir.
