THE FUNCTION OF THE COURTS ON THE JUDGEMENT OF THE CONFLICT ARISED FROM MILITARY OBLIGATION

Abstract

According to the Turkish Constitution article number 157 and the law number 1602 article number 20/1 “High Military Administrative Court shall be the first and last instance court for the judicial supervision of disputes arising from administrative transactions and actions involving military personnel and relating to military service, even if such transactions and actions have been carried out by civilian authorities. In the disputes arising from military service obligations, the condition of being a member of military personnel shall not be demanded”. According to these regulations, the procedures relating to military obligations are more comprehensive than military service. So, it is possible that some procedures relating to military obligations can not be defined as military service. Some procedures relating to military obligations should be under the function of ordinary administrative courts. The function of High Military Administrative Court (HMAC) is limited to the hearing of action of annulment and the hearing of compensation raised from military procedures. Getting into military service (conscription) is naturally an administrative process (transactions), not an administrative act. According to the law number 1602, it is possible to open a file of action of annulment or compensation against the regulatory process. Also, it should be accepted that a legal person has right to open a file at High Military Administrative Court against the regulatory process if these regulations are against the interest and/or against the right of this legal person.
