PHYSICIAN’S OBLIGATONS ON INFORMING AND GETTING CONSENTS FROM PATIENTS

According to these two reasons, the patient will be always a dependant of the practitioner: First, the patient has no knowledge about the issue although patient’s life, limb or organ is at risk; or second, the practitioner is a member of the occupational group that can solve his or her problem. In addition, the practitioner has always superiority over the patient. However, ideally, this relationship should depend on confidence. The first condition of this situation would be the practitioner’s clarification about the patient’s health problem, therapy and the results of this therapy, moreover the patient’s consent about the way of therapy and the results.

Hasta ile hekim arasındaki ilişki, hastanın hayatı veya bir uzvu tehlikede olmasına rağmen bu konuda hiç bilgi sahibi olmaması; hekimin de hastaya yardım edebilecek ve sorununu çözebilecek tek meslek grubuna mensup kişi olması dolayısıyla, adeta bir muhtaciyet ilişkisidir. Hekim, hastaya göre daha üstün durumdadır. Ancak ideal olarak bu ilişkinin bir güven ilişkisi olması gerekmektedir. Dolayısıyla, hasta hekime güvenmeli; hekim de hastanın güven duymasını sağlamalıdır. Bunun birinci şartı, hekimin hastayı, rahatsızlığı, tedavisi ve sonuçları konusunda geniş ve ayrıntılı bir biçimde aydınlatması ve daha da önemlisi, bu aydınlatma karşılığında hastanın -veya somut olayın gerektirmesi sonucu hasta yakınlarının- tedavi biçimine ve doğabilecek sonuçlar hususunda onay vermesi olacaktır.
