On the legal nature of postponement of the declaration of conviction and the unlawfulness of asking the accused whether he or she accepts that prior to the termination of the hearings.

It is a well known fact that in the practice of criminal proceedings that the criminal courts make while acting under the Article 231/6 of the Code of Criminal Proceedings, on whether the accused accepts the postponement of the declaration of conviction prior to the termination of the hearings. Nonetheless, such practice represents a diametrically opposite standpoint to the ratio legis of the institution. In this study, en effort is put, in the first place, on providing an answer to the question of when, or in which phase, to ask the accused whether he or she accepts the postponement of the declaration of conviction. Next, the legal nature of the institution, its place in the system of criminal sanctions and especially its relation to the postponement of the execution of imprisonment judgments are analyzed.

Ceza yargılaması pratiğinde mahkemelerinin CMK’nın 231/6. maddesi uyarınca sanığa hükmün açıklanmasını isteyip istemediğini duruşma evresinin sona ermesinden önce sordukları bilinmektedir. Oysa bu uygulama kurumun ihdas edilme amacıyla taban tabana zıttır. Makalede bir yandan hükmün açıklanmasının talep edip etmediğinin sanığı duruşmanın hangi aşamasında sorulması gerektiği üzerinde durulurken, bir yandan da kurumunun hukuki niteliği, ceza hukukunda yaptırımlar sistemindeki yeri ve özellikle hapis cezasının ertelenmesiyle ilişkisi üzerinde durulmaktadır.
