DISCIPLINARY PR OCEEDING AND PUNISHMENT SYSTEM RELATED TO PLAGIARISM CRIMES AT THE UNIVERSITIES BEFORE 2014

Plagiarism is described as ‘’using or taking the whole or part of somebody else’s scientific work without giving references and showing it as your own’’. While such an action is punished by dismissal of the person from the teaching profession at the university according to the Higher Education Disciplinary Regulations, it has been cancelled by the council of state, plenary session of the chambers for administrative cases on 20.09.2012 on the grounds that there is not such a crime prescribed by law. After the cancellation decision, a regulation was made for the plagiarism crime on 29.01.2014 and the punishment for this crime was determined as dismissing the person from the public service. However, the crimes that were committed between the data of 20.09.2012 (when the council of state, plenary session of the chambers for administrative cases cancelled the regulation) and 29.01.2014 (when the new regulation was made) became unpunished according to the fact that there is not a crime or punishment without the necessary law that describes them (Nulla poena sine lege). In the meantime, disciplinary proceedings for the university instructors by the higher education council have been made for the plagiarism crime. The most outstanding proceeding for this crime includes the complaints of Prof. Dr. Kemal Gözler as he claims that his works are used without being referred. In this article, the issue whether plagiarism crimes that were committed between the data of 20.09.2012 (when the council of state, plenary session of the chambers for administrative cases cancelled the regulation) and 29.01.2014 (when the new regulation was made) should be punished is handled by taking the complaints of Prof. Dr. Kemal Gözler as a ground. However, the basis of his claims is not evaluated.

İntihal; “Bir başkasının bilimsel eserinin veya çalışmasının tümünü veya bir kısmını kaynak belirtmeden kendi eseri gibi göstermek” olarak tanımlanmaktadır. Bu fiil; Yükseköğretim disiplin yönetmeliğinde, “üniversite öğretim mesleğinden çıkarma” cezası ile cezalandırılmakta iken Danıştay İdari Dava Daireleri Kurulu tarafından, 20.09.2012 tarihinde; “Kanunlarda bu şekilde bir ceza olmadığı” gerekçesi ile iptal edilmiştir. İptal kararından sonra intihal fiili ile ilgili cezai müeyyide ancak 29.01.2014 tarihli Yönetmelik değişikliği ile düzenleme altına alınmış ve bu fiilin cezası; “kamu görevinden çıkarma” olarak düzenlenmiştir. Ancak Danıştay’ın Yönetmelikteki intihal ile ilgili düzenlemeyi iptal ettiği 20.09.2012 tarihi ile yeni Yönetmelik hükmünün yürürlüğe girdiği 29.01.2014 tarihi arasındaki fiiller, kanunsuz suç ve ceza olmaz ilkesi gereği müeyyidesiz kalmıştır. Bu arada YÖK Başkanlığı tarafından intihal fiili nedeniyle öğretim elemanları hakkında disiplin soruşturmaları da sürdürülmekte olup bu soruşturmaların hukuk camiasında en ses getireni Prof. Dr. Kemal Gözler’ in, kendi bilimsel eserlerinin atıf yapılmaksızın kullanıldığına yönelik somut şikâyetleridir. Bu makalede, Danıştay’ın intihal fiili ile ilgili iptal kararından sonra yeni Yönetmelik hükmü yürürlüğe girinceye kadar geçen sürede intihal fiili nedeniyle ceza verilip verilemeyeceği hususu Prof. Dr. Kemal Gözler’ in kendi bilimsel yayınlarından intihal yapıldığına yönelik somut şikâyetleri esas alınarak incelenmektedir. İntihal iddialarının “esası” ile ilgili olarak ise bir değerlendirmede bulunulmamaktadır.
