CONCEPT OF THIRD PERSON’S OBTAINING SUPERIOR RIGHTS ON THE LEASED THING AFTER THE ESTABLISHMENT OF THE LEASE AGREEMENT

Turkish Code of Obligations (Law No: 6098) has entered into force on 1 July 2012. One of the changes made by this Code is, following the formation of the lease agreement; third parties become party to the contract should they obtain superior rights on the leased property. The person who acquires the ownership of the property subject to the lease agreement, after establishment of the contract, becomes party to this contract. Third person, that has real rights on the leased thing, which are affecting the tenants rights, also becomes a party to the lease agreement. In this study, terms and the consequences of becoming a party to the agreement, due to having superior rights on the leased thing following the formation of the lease agreement will be examined.

6098 Sayılı Türk Borçlar Kanunu, 1 Temmuz 2012 tarihinde yürürlüğe girmiştir. Bu Kanunla yapılan değişikliklerden biri de kira sözleşmesinin devamı sırasında üçüncü kişinin kiralanan şeyde üstün hak sahibi olması halinde sözleşmenin tarafı haline gelmesidir. Kira sözleşmesinin kurulmasından sonra, kiralanan şeyin mülkiyetinin üçüncü kişiye geçmesi halinde, mülkiyet hakkını kazanan kişi kira sözleşmesinin tarafı haline gelir. Üçüncü kişinin kiralanan şey üzerinde kiracının hakkını etkileyen bir aynî hak sahibi olması halinde de bu kişi kira sözleşmesinin tarafı haline gelir. Bu çalışmada, üçüncü kişinin kira sözleşmesinin kurulmasından sonra kiralanan şey üzerinde üstün hak sahibi olması nedeniyle sözleşmenin tarafı haline gelmesinin koşulları ve sonuçları incelenecektir
