SELECTIVITY IN THE PHENOMENON: THE DEFINITION OF THE RAPE

Rape is rape. One may ask why the definition of rape is needed. However, the definition of rape not only affects victims and perpetrators of rape this definition also affects the lives of many people. Even today, all kinds of coercive sex is not considered as rape. Because of this reason the definetion of rape is a very important issue. Unfortunately, rape is still defined by focusing on sexual assault. If there is no sexual assault in the rape, rape is ignored. Especialy in cases in which victims has no consents or are obligated to sexual intercourse or they have no possibility to resist, these kinds of sexual intercourses are not considered as rape. More precisely, there is a sexual intercourse not including forcible sexual assult, is not placed in the definition of rape. In other words, definition of other words, does not include sexual violence witout sexual assult. Thus in defining rape, selectivity in phenomenon is made. Therefore, the definition of rape is not only a matter of legal theory.

Tecavüz tecavüzdür. Tecavüzün tanımlanmasına ne gerek var ki diye düşü- nülebilir. Fakat tecavüz mağdurların katlanmak zorunda kaldıkları, direnme imkânlarının bulunmadığı her cinsel ilişki cinsel ilişki günümüzde bile tecavüz olarak değerlendirilmemektedir. Her türlü zora dayalı cinsellik hala tecavüz kabul olarak kabul edilmemektedir. Ne yazık ki tecavüz hala cinsel saldırıya odaklanılarak tanımlanmaktadır. Buradan hareketle tecavüzün tanımında olguda seçicilik yapılmasının yalnızca hukuk teorisiyle ilgili bir tartışma olmadığı söylenilebilir. Çok sayıda insanın rızasının olmadan yaşamak zorunda kaldıkları, başka bir değişle katlanmak zorunda kaldıkları cinsel ilişkilerde; bu insanların tecavüz mağduru olarak kabul edilmemesinin hukuk pratiği açısından da vahim sonuçları olduğu rahatlıkla ileri sürülebilir
