REPRESENTATION OF THE ADMINISTRATION AT JUDICIAL AUTHORITIES AND RESPONSIBILITY OF THE REPRESENTATIVES

Public authority and institutions hold the capacity of the concerned party in any legal and administrative cases relevant to their own business and procedures before arbitration and enforcement offices. In such cases the authorities are represented by their legal affairs managers, legal counsels, law procedures managers, attorneys and department heads in the capacity of their proxy. The Legislative Decree with no 659 which regulates this issue does not cover all public authority and institutions, due to various legal states that changes between the authorities for such representatives consequently cause different salary and personal benefits to prevail in practice. Therefore, a general employee law which covers all public authority and institutions and regulates the establishment and structure of legal departments, and all rights and liabilities of the representatives working in such departments from the start of their career in this profession until their retirement. In this study current legal status, representatives; legal, penal and disciplinary responsibilities of representatives are reviewed.

Kamu kurum ve kuruluşları kendi iş ve işlemleri ile ilgili olarak adli ve idari davalarla, tahkim ve icra mercilerinde taraf sıfatına sahiptirler. Bu davalarda idareleri vekil sıfatıyla hukuk birimi amirleri, hukuk müşavirleri, muhakemat müdürleri, avukatlar ve birim amirleri temsil etmektedir. Bu konuyu düzenleyen 659 sayılı KHK tüm kamu kurum ve kuruluşlarını kapsamamakta bu durum uygulamada temsilciler bakımından kurumdan kuruma değişen farklı hukuki statüler ve buna bağlı olarak farklı aylık ve özlük hakları sonucunu doğurmaktadır. Bu nedenle tüm kamu kurum ve kuruluşlarını kapsamına alan, hukuk birimlerinin kuruluşu, yapısı ve bu birimlerde çalışan temsilcilerin mesleğe alınmasından emekliliğe kadar tüm hak ve yükümlülüklerini düzenleyen genel bir personel kanununa ihtiyaç duyulmaktadır. Bu çalışmada mevcut yasal durum, temsilciler, temsilcilerin hukuki, cezai ve disiplin sorumluluğu ele alınmaktadır.
