Abstract
Social relations that become the subject of the legal disputes have got complicated as a
result of the imroving technology and usage of it in daily life and expertise have became
necessary in order the nature of some of these relations to be understood. In such cases the
judge who is obliged to conclude the case has needed to refer to the people having special
or technical knowledge which the judge has not had. The institution of expertise has
been established in order to meet this need. The parties of a case may need the opinion of
an expert so as to prepare their petitions, and to strengthen their claims and arguments.
Hence the expert assigned by the parties personally with the purpose of receiving (his)
opinion in a special or technical subject is called as the expert witness of/by parties. The
opinion of the expert witness is not an evidence but the statement of the party.
Abstract
Gelişen teknoloji ve bu teknolojinin günlük hayatta kullanımı sonucu hukukî uyuş-
mazlıklara konu olan sosyal ilişkiler karmaşıklaşmış ve bu ilişkilerin bir kısmının
niteliğinin anlaşılabilmesi uzmanlık gerektirir hale gelmiştir. Bu gibi hallerde, davayı
karara bağlamakla yükümlü olan hâkim, kendisinde bulunmayan özel veya teknik
bilgiye sahip kişilere başvurma ihtiyacı duymuştur. Bu ihtiyacı gidermek üzere bilirkişilik
kurumu ihdas edilmiştir. Davanın tarafları da dilekçelerini hazırlayabilmek,
iddia ve savunmalarını güçlendirebilmek için uzman görüşüne ihtiyaç duyabilirler.
İşte, tarafların bizzat belirledikleri, özel veya teknik bir konuda görüşünü almak
üzere başvurdukları uzmana uzman tanık denilmektedir. Uzman tanığın görüşü
delil olmayıp taraf beyanıdır
