Tourette sendromu ve ceza sorumluluğu: Bir olgu sunumu

Abstract

Tourette sendromu, çocukluk çağı başlangıçlı, motor ve vokal tiklerle karakterize nörogelişimsel bir bozukluktur. Tourette sendromuna sıklıkla başka ruhsal bozuklukların ya da davranış sorunlarının eşlik ettiği bilinmektedir. Tourette sendromu kendilik saygısı, aile yaşamı, toplumsal kabul ve iş veya okuldaki işlevlerde zorluklara neden olabilmektedir. Literatürde Tourette sendromu olan bireylerin yasal sorumluluklarıyla ilgili sınırlı sayıda bilgi bulunmaktadır. Biz bu yazımızda Tourette sendromu tanısı olan ve işlediği basit yaralama suçu ile ilgili Türk Ceza Kanunun 32. Maddesi bağlamında değerlendirilmek üzere mahkeme tarafından polikliniğimize yönlendirilen 16 yaşındaki bir olguyu sunmayı amaçladık.

Tourette syndrome and criminal responsibility: A case report

Abstract

Tourette syndrome is a neurodevelopmental disorder characterized by childhood onset, motor and vocal tics. It is known that Tourette syndrome is often accompanied by other mental disorders or behavioral problems. Tourette syndrome can cause difficulties in self-esteem, family life, social acceptance and functioning at work or school. There is limited information about Tourette syndrome and its legal responsibilities in the literature. In this article, we aimed to present a 16 year-old case with Tourette syndrome who was directed to our clinic by the court to be evaluated in the context of Article 32 of the Turkish Penal Code in regard to simple injury crime.
