Abstract

Maluliyet, adli tıp pratiğinde sıkça karşılaşılan bir kavramdır. Maluliyet değerlendirmesi dava konusu olay tarihinde yürürlükte olan mevzuat uyarınca yapılmaktadır. Ancak ülkemizde maluliyet oranı hesaplanmasında çeşitli tarihlerde Resmî Gazete’de yayımlanmış farklı mevzuat ve yönetmeliklerin hiçbiri travma sonrası kişide meydana gelen arazlara özgü düzenlenmediğinden uygulamada ilginç durumlarla karşılaşılabilmektedir. Olgumuz ışığında yönetmelikteki eksik noktaların örnekler ile birlikte tartışılması amaçlanmaktadır. Pratikte karşılaşılan mevcut yönetmeliklerin eksik kaldığı hususlar göz önünde bulundurularak travmaya özgü kapsamlı güncel bir yönetmelik oluşturulması, haksız fiile uğrayan kişinin hak kaybının önlenmesine katkıda bulunacaktır.

Disability assessment of tibia and talus fractures healed by sequelae: A case report

Abstract

Disability is a frequently encountered concept in forensic medical practice, and it is assessed in accordance with the legislation in force at the time of the incident. However, since none of the laws or regulations published in the Official Gazette on various dates in the calculation of disability rate in Turkey are specific to the symptoms that occur after trauma, interesting situations are known to be encountered in practice. In light of this, the aim of this study was to discuss the missing points in the regulation, together with examples. Considering the deficiencies of current regulations encountered in practice, creating a comprehensive, up-to-date regulation specific to trauma will contribute to the prevention of the loss of rights of those who have been subjected to wrongdoing.
