Abstract

Türkiye’de geçmişten bu yana
“cinsel suç işleyen veya cinsel
davranım problemi olan çocuk”
sorunu küçümsenmiş veya göz
ardı edilmiştir. Failin çocuk olduğu cinsel istismar veya saldırı
vakaları ya örtbas edilmiş ya da
fail olduğu iddia edilen çocuklar
yetişkin cinsel suçlularla aynı
yasalar kapsamında değerlendirilmişlerdir. Diğer yandan, ülkemiz ve doğusundaki birçok ülkede ise çocuk cinsel istismarcı
popülâsyonuna yönelik oturtulmuş tıbbi ve hukuki bir yaklaşım
modelinin olmadığı görülmektedir. Bu yazıda, literatür ışığında;
çocuk cinsel istismarcı kavramının tanımlanması, cinsel suç
işleyen çocuklara yönelik uluslar arası uygulamaların tartışılması, bu popülasyona özgü
yaklaşım /düzenleme oluşturulması gerekliliği ve bu bağlamda
cinsel suç işlediği iddia edilen
çocuklara yönelik tıbbi ve hukuki çalışmaların tetiklenmesi
amaçlandı.
