Abstract

Establishment of an independent monitoring system for the inspection of police offi cers by civilians and/or civil institutions is already implemented in some western countries. As a country that is on the path of EU membership, the need of such monitoring system is expressed in the progress reports. In response to these requirements, the Police Oversight Commission was established in Turkey with the Law No. 6713.The presence of aforementioned mechanism for the effective monitoring as well as the fullfi lment of the EU membership criteria is a necessity, yet not satisfactory. Ensuring the independence of the monitoring mechanism which is also equipped with appropriate authorities is also an obligation. In this article, the essential aspects which must be granted to such a comission for an effective monitoring is discussed by evaluating other countries’ practises and Turkish Police Oversight Comission

Kolluk Gözetim Komisyonu

Abstract

Kolluk personelinin sivil kişi ve makamlar tarafından denetlenmesi ve bunun için bağımsız kolluk denetim sistemi kurulması, bazı batılı ülkelerde hali hazırda uygulanmaktadır. AB üyelik sürecindeki Türkiye için de, ilerleme raporlarında, bu tür bir denetim sistemi kurulması gereği dile getirilmektedir. Bu gereklilik karşısında Türkiye’de 6713 sayılı Kanunla1 Kolluk Gözetim Komisyonu kurulmuştur. AB üyelik kriterlerinin gerçekleştirilmesi ve kolluğun sivil kişi ve kurumlarca etkin bir şekilde denetlenmesi için bahsi geçen mekanizmanın mevcudiyeti tek başına yeterli olmayıp kurulacak denetim biriminin bağımsızlığının sağlanması; uygun yetkilerle donatılması da gerekmektedir. Bu makalede; yabancı ülke uygulama örnekleri ve literatürde yer alan görüşler ışığında kolluk denetim birimlerinin etkin olabilmesi için bu birimlerin sahip olması gereken nitelikler ve 6713 sayılı Kanunla kurulan Kolluk Gözetim Komisyonunun bu nitelikleri taşıyıp taşımadığı incelenecektir
