Adil Yargılanma Hakkı ve Saddam Hüseyin Davası

Abstract

Irak savaşının sona ermesinden sonra Saddam Hüseyin ve Baas Yönetimi ileri gelenleri, 1968-2003 yılları arasında işlendiği iddia edilen insanlığa karşı suçlar, savaş suçları ve soykırım suçu ile suçlanmıştır. Bu süre içerisinde Baas rejimi, beşyüzbinden fazla kişinin ölümüne neden olmak, insanlık dışı muamelede bulunmak ve ciddi insan hakları ihlalleri ile itham edilmiştir. İsnat edilen suçlar nedeniyle Saddam Hüseyin ve Baas Yöneticilerinin hangi mahkemede yargılanacağı hususu, Birleşmiş Milletler(BM), Amerika Birleşik Devletleri (ABD) ve sivil toplum kuruluşları tarafından farklı platformlarda tartışılmıştır.Tamamen uluslararası unsurlardan oluşan bir mahkemeden, Iraklı hakimlerle birlikte uluslararası hukukçuların katılacağı karma mahkemeye veya uluslararası camianın desteği ile iç hukuka göre yargılama yapacak bir mahkemeye kadar pek çok alternatif ele alınmıştır. Uluslararası hukukçular tarafından, Iraklı hakimlerin de katıldığı uluslararası bir ceza mahkemesi kurulmasının faydalı olacağı ifade edilmesine karşın, Irak Geçici Yönetimi tarafından yerel bir ceza mahkemesi kurulmasına karar verilmiştir. Ancak, sadece Iraklı hakimlerden oluşan bir mahkemenin varlığı, mahkemenin yetkinliği ve tarafsızlığı üzerine tartışmalara neden olmuş, yargılama sırasında mahkemenin masumiyet karinesi, silahların eşitliği ve tanıkların korunması gibi konularda adil yargılanma hakkı ilkesini ihlal ettiği vurgulanmıştır

RIGHT TO A FAIR TRIAL AND SADDAM HUSSEIN CASE

Abstract

After Iraq war, Saddam Hussein and his co-defendants accused of committing genocide, crimes against humanity, war crimes commited between 1968 and 2003. It has been claimed that the widespread and systematic violence and atrocities of the Ba’athist regime caused nearly five hundred thousand deaths and numerous human rights abuse. The question of which institution should try Saddam Hussein and his co-defendants was discussed by The United States, the United Nations, and nongovermental organizations in different platforms. There were several alternatives from purely international courts to hybrid international domestic tribunals to domestic courts which would receive some degree of international support and assistance. Although international judicial experts indicated the advantages of an international criminal court with domestic participation, Iraqi Governing Council decided to establish a domestic tribunal . However, the choice of a domestic court raised serious concern about the competence and impartiality of judges due to the fact that tribunal would only be consisted of Iraqi judges. It is argued that the Tribunal has been far from to conduct a fair trial regarding witness protection, the presumption of innocence and the principle of equality of arms
