ÖZEL HAYATA SAYGI HAKKI (AİHS 8. MADDE) BAĞLAMINDA ÇALIŞMA HAKKI VE MESLEKİ HAYAT İLİŞKİSİ

Abstract

Ekonomik ve sosyal haklardan olan çalışma hakkı Avrupa İnsan Hakları Sözleşmesi’nde korunan haklardan değildir. Ancak Avrupa İnsan Hakları Mahkemesi, çalışma hakkı kapsamında değerlendirilebilecek bazı konularla ilgili şikâyetlerin Sözleşme'de korunan diğer hakları ilgilendirmesi durumunda ilgili haklarla bağlantı kurarak bir inceleme yapabilmektedir. Çalışma hakkıyla ve mesleki hayatla ilgili pek çok konu Sözleşme’nin 8. maddesinde düzenlenmiş olan özel hayata saygı hakkının kapsamına girebilmektedir. AİHM içtihadına göre özel hayata dair hususlar kişinin mesleği ile ilgili tasarruflara esas alınmışsa özel hayata saygı hakkı gündeme gelecektir. Bu kapsamda mesleki hayat çerçevesinde kişilerin özel hayatı hakkında sorgulanması ve bunun doğurduğu idari sonuçlar, buna ek olarak kişilerin davranış ve tutumları gerekçe gösterilerek görevden alınmaları özel hayata yapılmış bir müdahale oluşturmaktadır. Bu durumlarda Sözleşme’nin 8. maddesinde yer alan güvenceler devreye girecektir. AİHM kararlarında çalışma hakkı bakımından en önemli kriter bireylerin dış dünyayla ve başka bireylerle ilişki kurması bakımından mesleki yaşamın, mesleki faaliyetlerin bir araç olarak görülmesi ve bu sayede mesleki yaşamın özel yaşamın ayrılmaz bir unsuru olarak kabul edilmesidir.
