Abstract

Ceza muhakemesinde soruşturma evresinde gerçekleştirilen teşhis işlemi ile şüphelinin fail olup olmadığı tespit edilmeye çalışılır. Muhakeme ile ispatlanmak istenen olayı, duyu organları vasıtasıyla algılayan tanığın ve mağdurun beyanlarına dayanan teşhis işleminin hatalı olduğuna sıklıkla rastlanmaktadır. Teşhisi yürüten görevlilerin, tanık üzerinde yönlendirici etkide bulunması, bu hatalı sonuçların ortaya çıkmasında ciddi rol oynar. Bu çalışmanın temel amacı, teşhis sürecinde yaşanan, işlemin sağlıklı bir şekilde tezahür etmesini engelleyen ve teşhisi yürüten görevlilerin davranışlarından kaynaklanan sorunları açıklamak, bu sorunların giderilmesi için çözüm yolları sunmaktır. Bu suretle maddi gerçeğin araştırılmasında ideal bir teşhis işleminin nasıl olması gerektiğine ilişkin bir çerçeve çizerek uygulamaya katkı sağlamak hedeflenmiştir. Aynı amaç doğrultusunda teşhis türlerinin ispat kuvveti ve güvenilirliği meselesi de ele alınmıştır.

The Ideal Procedure of Police Lineup in Criminal Procedure Law: An Evaluation Based on Data from Forensic Psychology

Abstract

In criminal procedure law, the police lineup process carried out during the investigation phase aims to determine whether the suspect is the perpetrator or not. It is quite common for police lineup, based on the statements of witnesses and victims who have perceived the fact through their senses, to be inaccurate. The fact that officers managing the identification process can have leading impacts on witnesses plays a significant role in the occurrence of such inaccurate outcomes. The main goal of this study is to explain the issues that arise in the process of police lineup, which hinder its accurate conduct and stem from the behaviours of officers managing the procedure, as well as to suggest solutions to deal with them. In this respect, it is aimed to contribute to relevant practice by providing a framework on how an ideal procedure should be carried out while investigating the factual truth. In line with this purpose, the study also examines the probative value and reliability of different types of police lineups.
