Establishing Contact between the Foster Family and the Child

Abstract

A foster family is a family or person who takes care of a child in need of protection. The foster family takes responsibility for the development of the child and has a close relation with the child. Article 325 of the Turkish Civil Code regulates the right of third parties to contact with the child. According to this provision, the foster family may request contact with the child. Establishing contact between the foster family and the child depends on the existence of extraordinary circumstances and the best interest of the child in having contact. Although there is a positive and close relation between the foster family and the child, foster family's inability to contact with the child indicates the existence of an extraordinary circumstance. In this case, if establishing contact with the foster family contributes to the physical, mental and social development of the child, the foster family should be allowed to have contact with the child. The views of the child should be taken into consideration before the contact between the foster family and the child is allowed. If the contact with the child has endangered the best interests of the child, it may be restricted or withdrawn. The restrictions of the contact between the foster family and the child are determined by analogy to Article 324 of the Turkish Civil Code. This study examines the concept of foster family and the foster family's right of contact with the child. In this framework, the conditions for the foster family to contact with the child and the restrictions of contact are discussed.
