An Example of Criminal Liability Arising From Earthquake in Islamic Law: Jinayat Al-Hait

Abstract

Earthquakes, which directly concern law and especially criminal law due to their consequences in terms of social life and manifest themselves from time to time, can turn into relentless traps and weapons of mass destruction when combined with the sloppy and careless behavior of human beings. On the one hand, earthquake causes death and injury due to the collapse of buildings or structures, and on the other hand, it provides an opportunity to potential criminals due to the atmosphere of fear, chaos and chaos it creates. From the moment it was first preached to the present day, Islamic jurists have determined the rules and prohibitions regarding every aspect of life down to the smallest detail and have left us a rich legacy of material on law. It is also possible to find information about the earthquake and its harmful consequences within the resources in question. In this study, the topic of "walls that are about to collapse" in classical Islamic law sources is examined in the context of death and injury incidents that occur as a result of the collapse of buildings or structures due to behaviors contrary to the obligation of care and attention. In this context, the special elements of the crime of cinâyet-i hâit have been identified with today's understanding of law, sometimes by comparing it with positive law and by making use of judicial decisions, each of the detected elements has been examined separately and the sanctions envisaged for the crime have been mentioned.
