YÜRÜTME ERKİNDEKİ SİYASİ DANIŞMANLIK YAPISININ DEMOKRATİK SORUMLULUK İLKESİ AÇISINDAN İNCELENMESİ

Abstract

Bu çalışma, yürütme erkinde yer alan siyasi danışmanların demokratik sorumluluğunun kurulmasına ilişkindir. Yürütmeyi, devlet başkanı, hükümet ve idari teşkilattan oluşan sınırlı bir yapı olarak tasavvur eden geleneksel teori siyasi danışmanları kuramsal olarak dışlar. Oysa modern devletlerde yürütmenin kişiselleşmesi ve karar alma süreçlerinin merkezileşmesi gibi sebeplerle yürütmenin yapısal genişlemesi sonucunda siyasi danışmanlar politika süreçlerinde etkili aktörler haline gelmiştir. Bu durum, anayasalarda açıkça yer almamakla birlikte yürütmenin fiili işleyişinde önemli rol oynayan yeni bir kurumsal katmanın ortaya çıkmasına yol açmıştır. Aristoteles, Locke ve Montesquieu’den, çağdaş çekirdek yürütme ve politika danışma sistemleri yaklaşımlarına uzanan bir çerçevede yürütmenin dönüşümünü incelenmekte, siyasi danışman kavramı karşılaştırmalı yöntemle tanımlanmaktadır. Karşılaştırmalı anayasalarda -Norveç Anayasası istisna olmak üzere- siyasi danışman düzenlemesinin tercih edilmediği tespit edilmiştir. Siyasi danışmanların yürütmedeki konumunu yalnızca hükümet sistemleriyle açıklamak yetersiz kalmaktadır. Bu noktada farklı devletlerde belirleyicinin yürütmenin iç yapılanması olduğu ve demokratik sorumluluğun kurulma biçiminin esas olduğu anlaşılmaktadır. Türkiye’de 2017 Anayasa değişikliklerinden sonra ortaya çıkan çok katmanlı danışmanlık yapısını öngören mevcut düzenlemelerin, siyasi danışmanların görev, yetki, atanma usulleri ve hesap verebilirlik hususlarını düzenlemesi bakımından parçalı ve belirsiz olduğu değerlendirilmektedir. Anayasada öngörülen mevcut düzen ile yürütmenin fiili işleyişi arasındaki uyumsuzluğun demokratik sorumluluk ilkesi bakımından yarattığı sorunlar ve siyasi danışmanlık kurumuna ilişkin normatif düzenlenme ihtiyacı vurgulanmaktadır.

POLITICAL ADVISORS WITHIN THE EXECUTIVE BRANCH: A CONSTITUTIONAL ANALYSIS OF DEMOCRATIC ACCOUNTABILITY

Abstract

This study focuses on the establishment of democratic accountability for political advisors within the executive branch. Traditional theory, which conceives of the executive as a limited structure consisting of the head of state, the government, and the administrative organization, theoretically excludes political advisors. However, in modern states, due to factors such as the personalization of the executive and the centralization of decision-making processes, political advisors have become influential actors in policy processes as a result of the structural expansion of the executive. This situation has led to the emergence of a new institutional layer that plays a significant role in the de facto functioning of the executive, even if not explicitly stated in constitutions. The transformation of the executive is examined within a framework extending from Aristotle, Locke, and Montesquieu to contemporary approaches to core executive and policy advisory systems, and the concept of political advisor is defined using a comparative method. It has been observed that, with the exception of the Norwegian Constitution, the provision of political advisor arrangements is not preferred in comparative constitutions. Explaining the position of political advisors in the executive solely through government systems is insufficient. At this point, it is understood that the determining factor in different states is the internal structure of the executive and the way in which democratic accountability is established. It is assessed that the current regulations in Türkiye, which envisage a multi-layered advisory structure after the 2017 constitutional amendments, are fragmented and unclear in terms of regulating the duties, powers, appointment procedures, and accountability of political advisors. The inconsistencies between the existing system envisioned in the Constitution and the actual functioning of the executive branch create problems in terms of the principle of democratic responsibility, and the need for normative regulation regarding the institution of political advisory is emphasized.
