THE RIGHT TO ENTER THE PUBLIC SERVICE OF THE DISABLED IN TURKISH LAW

Abstract

In Turkish law, the right to enter the public service is regulated in the 70th article of the 1982 Constitution. The content and scope of the right to enter the public service, which is regulated under the status of political rights in the Constitution, has been established by laws and judicial decisions. The right to enter public service constitutes a dimension of the right to work, which is another fundamental right, and is necessary in terms of ensuring the material and moral development of the person and living a life worthy of human dignity. Persons with disabilities, who cannot participate in social life equally with other individuals, also have the right to enter public service in accordance with the principle of equality, which is a constitutional principle. However, "equality under the law" is not sufficient for disabled people to enter the public service. Therefore, in the context of constitutions and other legal regulations, various practices that will constitute positive discrimination in terms of entering the public service of the disabled are envisaged. Apart from this exam, it is possible for the disabled to be employed in the public sector, judicial decisions envisaging otherwise will be against the law. In terms of persons with disabilities, the special conditions imposed in order to be able to apply to public administrations and institutions as public personnel should not constitute discrimination. Such transactions of the administration will constitute a violation of the principle of equality. Within the scope of this study, some important legal issues in terms of the right to enter the public service and the use of this right by the disabled are discussed.
