Uluslararasılasmıs Kosova Mahkeme Sistemi

Abstract

Kosova’da yaşanan etnik çatışmalar, uluslararası toplumun müdahalesi ile durdurulmuş ve akabinde BM, UNMIK aracılığıyla Kosova’yı yönetmeye başlamıştır. UNMIK, yaşanan etnik çatışmalarda sırasında işlenen insancıl hukuk ihlallerinin yargılanması için mevcut Kosova mahkeme sistemi içine uluslararası yargıç ve savcıları dahil etmiştir. Böylece, Kosova mahkeme sistemi uluslararasılaşmış bir niteliğe bürünmüştür. Akabinde bu sistem, EULEX tarafından da devam ettirilmiştir. Bu çalışmanın amacı, uluslararasılaşmış Kosova mahkeme sistemini tanıtmak ve BM başta olmak üzere, uluslararası toplumun Kosova mahkemelerinin tarafsızlık ve bağımsızlığının sağlanması ve Kosova yargı sistemini geliştirmeye yönelik çabalarını ortaya koymaktır
